    1. MUV (“we”, “us”, “our”, or “the Company”) respects your privacy and is committed to complying with Australia’s privacy laws, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
    2. This Privacy Policy describes how we collect, use, store, disclose, and secure personal information (including marketing data, phone numbers, and browsing/viewing history) in the course of operating our website, marketing, and related services.
    3. This policy applies to all individuals whose personal information we hold, including subscribers, site visitors, leads, customers, and potential customers.
  2. What Information We Collect

    We may collect the following categories of personal and behavioural information, but only when necessary and with appropriate safeguards:

    • Contact Information & Identity

      – Name, email address, postal address, phone/mobile number, where you voluntarily provide it (e.g. subscription forms, inquiries).

    • Browsing / Viewing History & Behavioural Data

      – Pages visited, vehicles viewed, time on page, search queries, click-throughs, referral URLs, device/browser metadata (e.g. IP address, device type, operating system).

    • Marketing Interaction Data

      – Email open/click data, SMS response data, campaign interaction metrics.

    • Other Data

      – Preferences, feedback, or user‐submitted content.

    We do not collect sensitive personal information (e.g. health, race, political opinions) unless explicitly consented to and permitted by law.

  3. Legal Basis & APP Compliance

    • Open & Transparent Practices (APP 1 & 5)

      We commit to managing personal information openly and transparently, including publishing and keeping current this Privacy Policy.

      At or before collecting data, we will notify individuals about:

      • The identity and contact details of our organisation,
      • The purposes of collection,
      • The types of data collected,
      • Whether disclosure is voluntary or mandatory,
      • Any third parties or overseas recipients,
      • How to access and correct their data, and how to opt out of marketing.

    • Collection (APP 3 & 4)

      We only collect personal information that is reasonably necessary for our functions or activities (e.g. marketing, matching vehicles, analysing preferences). unsolicited personal information will be handled per APP 4.

    • Use & Disclosure (APP 6 & 7)

      We will use or disclose personal information only for the primary purpose for which it was collected (or for a related secondary purpose where reasonable).

      For direct marketing, we must comply with APP 7:

      1. Where we use or disclose personal information for direct marketing, it must be for an individual’s marketing of products or services, and the person must have a reasonable expectation that their data will be used that way (or consent).
      2. Every direct marketing communication must include a simple, prominent mechanism to opt out (unsubscribe).
      3. We must honour opt-out requests within a reasonable time and cannot charge individuals to opt-out.
      4. Use of tracking pixels or targeted ads must comply with transparency and opt out rules.
    • Cross-Border Disclosure (APP 8)

      If we transfer personal information overseas (e.g. to cloud providers or analytics partners), we must ensure those recipients handle the data in a standard consistent with APPs (or obtain consent).

    • Data Quality (APP 10)

      We will take reasonable steps to ensure personal data we collect, use, or disclose is accurate, up-to-date, and complete for its purpose.

    • Security (APP 11)

      We will take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification or disclosure. When personal information is no longer needed, we will destroy or de-identify it.

    • Access & Correction (APP 12 & 13)

      Individuals have the right to request access to the personal information we hold about them, and to request correction if it is inaccurate, out-of-date, incomplete, irrelevant, or misleading. We will respond within a reasonable period (typically 30 days) unless an exception applies.

  4. Storage, Security & Retention

    1. Storage & Security

      • Data is stored on secure servers, either operated by us or via third party service providers with strong security practices (encryption, access controls, firewalls, audits).
      • Access to personal information is restricted to authorised personnel on a “need-to-know” basis.
      • We regularly review and update security measures.
      • Third party providers (e.g. email/SMS platforms, analytics tools) will be contractually required to adhere to privacy and security obligations (i.e., they must treat data reliably and in compliance with APPs).
    2. Retention & Deletion

      • We will retain personal information only as long as necessary for the purpose(s) for which it was collected, or as required by law.
      • When the information is no longer needed, we will take reasonable steps to securely delete or de-identify it.
      • For marketing data (viewing history, interaction logs), we may retain de identified or aggregated data for analytics beyond individual-level retention if it cannot be re-identified.
  5. Use of Cookies, Tracking & Analytics

    • We use cookies, web beacons, tracking pixels, or similar technologies to collect usage and behavioural data, to personalise your experience and conduct analytics.
    • At the time of first site visit, or via a banner, we will notify users of such tracking and give them the choice to opt out of targeted ads or tracking pixels.
    • We ensure transparency by describing the types of tracking used, third-party trackers, and how users can disable or opt out (e.g. via browser settings or a preference centre).
  6. Direct Marketing & Communications

    • We may send marketing communications (emails, SMS, phone calls) to individuals whose contact details we have collected, subject to compliance with APP 7 and the Spam Act 2003 (Cth) (which requires consent, accurate sender identification, and a functional unsubscribe facility).
    • We will always include a prominent, easy-to-use opt-out/unsubscribe link or instructions in each communication.
    • If a user opts out, we will cease direct marketing to them within a reasonable time (and we will not charge them for opting out).
    • Where marketing is done via third-party data or through service providers, we must ensure proper consent and opt-out mechanisms are upheld.
  7. Cross-Border Transfers & Third-Party Providers

    • If personal information is transferred overseas, we will only do so if:

      1. The overseas recipient is subject to laws or binding contractual obligations equivalent to the APPs; or
      2. The individual consents to the transfer; or
      3. An exception under APP 8 applies.

    • We are mindful that third-party providers (e.g. analytics, cloud, SMS vendors) are often a “weak spot” for privacy risk. We require them through contracts to maintain privacy and security standards.
  8. Data Breach Notification

    • We implement a data breach response plan.
    • Under the Notifiable Data Breaches (NDB) scheme, if there is an “eligible data breach” (i.e. likely to result in serious harm), we will:

      1. Notify affected individuals; and
      2. Notify the Office of the Australian Information Commissioner (OAIC).

    • We will take steps to contain and remediate the breach and document our response.
  9. Your Rights & Controls

    You have the following rights:

    1. Access your personal information, including details of how we have used or disclosed it.
    2. Correction – ask us to correct any inaccuracies or incomplete data.
    3. Opt-Out / Stop Marketing – withdraw consent or opt out of direct marketing at any time.
    4. Request deletion or de identification, subject to legal or operational retention obligations.
    5. Complain – contact us if you believe we have breached our privacy obligations. We will investigate and respond.
    6. If unsatisfied, you can complain to the OAIC.

    Requests will generally be processed within 30 days, unless a valid exception applies.

  10. Updates to This Policy & Version Control

    • We may periodically update or amend this Privacy Policy (e.g. in response to legal changes, operational changes, or new data practices).
    • Whenever changes are made, we will publish the updated version with a new “Last Updated” date, and, where appropriate, notify users.

Mobile Terms of Service

Melbourne Used Vehicles

The Melbourne Used Vehicles mobile message service (the "Service") is operated by MUV (“Melbourne Used Vehicles”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Melbourne Used Vehicles’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Melbourne Used Vehicles through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Melbourne Used Vehicles. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to MUV AU or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Melbourne Used Vehicles mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
